TERMS & CONDITIONS

Business Victor Harbor Membership Terms & Conditions

This agreement applies between you, the membership applicant or member, and Business Victor Harbor Inc. (ABN: 19 578 009 571) (“BVH”, “we”, “our”, or “us”).

1. Membership Overview

Business Victor Harbor Inc. (BVH) offers memberships designed to support local businesses through connections, programs, events, advocacy, and promotional opportunities.

Membership tiers may include:

  • Essentials

  • Kickstart

  • Associate

  • Free Associate (available to eligible not-for-profit organisations)

BVH may update membership tiers, pricing, or benefits from time to time to support the ongoing operation and improvement of the organisation.

2. Eligibility

  • Membership is open to businesses and organisations operating in or connected to the Victor Harbor region.

  • The Free Associate tier is reserved for approved not-for-profit organisations and is subject to eligibility criteria determined by BVH.

  • BVH reserves the right to approve, decline, suspend, or terminate any membership application or membership at its discretion.

3. Membership Status

Memberships are issued to the approved business or organisation and are non-transferable without written approval from BVH.

4. Membership Fees & Billing

Paid memberships are available on a monthly or annual subscription basis.

By subscribing, you authorise BVH to automatically charge your nominated payment method on each renewal date.

Payments are securely processed via Stripe. BVH does not store full card details.

Membership fees are non-refundable except where required under Australian Consumer Law.

BVH may adjust pricing with reasonable notice.

If automatic payment fails, BVH may retry payment and suspend membership benefits until payment is resolved.

5. Renewal & Cancellation

Memberships automatically renew unless cancelled.

You may cancel your membership at any time via the billing portal or by contacting BVH.

Cancellation takes effect at the end of the current billing period.

No partial refunds are provided for unused membership periods.

BVH may suspend or terminate membership for non-payment or breach of these Terms.

6. Membership Benefits

Membership benefits vary by tier and may include access to:

  • events and networking opportunities

  • programs and workshops

  • business introductions

  • promotional opportunities

  • member resources and communications

BVH does not guarantee specific business outcomes, referrals, sales, partnerships, funding, or results arising from membership.

7. Member Conduct

Members agree to:

  • act professionally and respectfully

  • engage in good faith with other members

  • not misuse BVH platforms, events, communications, or connections

  • comply with applicable laws and regulations

BVH may suspend or terminate membership where conduct is considered inappropriate, harmful, unlawful, or inconsistent with BVH values.

8. Data Use & Member Directory

By becoming a member, you agree that BVH may:

  • publish your business details within member directories

  • display your business name, logo, website, and contact details on BVH platforms

  • use your information to support programs, initiatives, events, and member engagement

BVH may share limited business contact information with relevant members, sponsors, or partners where reasonably connected to BVH programs, opportunities, or member benefits.

You may request updates or removal of your directory information at any time.

9. Partner & Sponsor Introductions

BVH may introduce members to sponsors, partners, service providers, or other organisations where opportunities may be relevant to your business.

By opting into these opportunities, you consent to BVH sharing relevant business contact details for this purpose.

10. Program-Specific Requirements

Certain BVH programs may have additional participation requirements.

Entrepreneurs Program / Growth Program

If you participate in these programs, you agree that:

  • you may be required to maintain your primary business banking relationship with Community Bank Fleurieu (powered by Bendigo Bank)

  • you may be required to provide access to relevant business performance information, including turnover data

  • information may be provided through secure third-party integrations such as Xero

  • data will be used solely for program delivery, reporting, benchmarking, insights, and support purposes

BVH will take reasonable steps to maintain the confidentiality of any non-public business information provided through program participation.

Failure to meet applicable program requirements may result in removal from the program.

11. Marketing & Communications

By becoming a member, you consent to receiving:

  • BVH newsletters and updates

  • event invitations

  • program and member communications

Communications may be delivered through platforms such as Mailchimp or other approved communication systems.

You may unsubscribe from marketing communications at any time.

12. Brand Victor Harbor

Applications to use Brand Victor Harbor are subject to separate terms and approval processes.

Membership does not guarantee approval to use Brand Victor Harbor assets or branding.

13. Events & Activities

BVH facilitates events, introductions, networking opportunities, and community activities.

Unless expressly stated otherwise, BVH is not responsible for:

  • third-party events or services

  • outcomes arising from member interactions

  • commercial agreements between members

  • decisions made following participation in BVH activities

Members are responsible for conducting their own due diligence before entering into commercial arrangements.

Participation in events and activities is at your own risk.

14. Limitation of Liability

To the extent permitted by law, BVH is not liable for:

  • loss of business, revenue, profits, or opportunity

  • outcomes arising from introductions, referrals, or partnerships

  • interruptions to services, events, or communications

  • actions or conduct of third parties

Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded under Australian Consumer Law.

15. Use of Name & Logo

By becoming a member, you grant BVH permission to:

  • display your business name and logo on BVH platforms, including the website, member directory, social media, and promotional materials

  • refer to your business as a BVH member in marketing, communications, and case studies

This use is for promotional and community-building purposes only and does not imply formal endorsement, certification, or partnership by BVH.

You may request removal of your logo or business details at any time by contacting BVH.

16. Changes to Terms

BVH may update these Terms from time to time.

Continued membership following any updates constitutes acceptance of the revised Terms.

17. No Waiver

Failure by BVH to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

18. Third Party Rights

Nothing in these Terms creates rights in favour of any third party.

19. Governing Law

These Terms are governed by the laws of South Australia, Australia.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of South Australia.
